These Terms and Conditions govern access to and use of Eyedeea Photos, including related websites, applications, APIs, storage, photo-processing features, household sharing features, subscriptions, and support services. By accessing or using Eyedeea Photos, a user agrees to these terms.
Eligibility and Accounts
Users must provide accurate account information and keep it up to date. Users are responsible for activity that occurs under their accounts and for maintaining the confidentiality of login credentials.
If household, team, or shared-library access is supported, the account owner or administrator is responsible for managing roles, permissions, and authorized access.
Use of the Service
Users may use Eyedeea Photos only in compliance with applicable law and these terms. Users may not:
- Use the service for unlawful, infringing, fraudulent, abusive, or harmful activity.
- Interfere with or disrupt the service, infrastructure, security features, or other users' access.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Upload or distribute malware, malicious code, or harmful content.
- Use the service to violate privacy, publicity, intellectual property, or other rights.
- Reverse engineer, scrape, or misuse the service except to the extent such restriction is prohibited by applicable law.
User Content
Users retain ownership of the photos, files, and other content they upload or provide to Eyedeea Photos.
By using the service, users grant Eyedeea Photos a limited license to host, store, copy, transmit, process, analyze, modify, display, and create derivative outputs from that content solely as needed to operate, secure, improve, and provide the service. This includes actions such as generating thumbnails, metadata, search indexes, face groupings, album names, curation outputs, slideshows, and reels.
Users are responsible for ensuring they have all rights and permissions necessary to upload and use their content with the service.
AI and Automated Outputs
Eyedeea Photos may use automated systems and AI-assisted processing to analyze and organize content. Generated outputs may include classifications, rankings, groupings, naming suggestions, face clusters, privacy labels, and other recommendations.
These outputs are provided for convenience and may not always be accurate, complete, or appropriate for every use case. Users remain responsible for reviewing important results before relying on them.
Privacy
Use of Eyedeea Photos is also subject to the Privacy Policy.
Subscriptions, Billing, and Plans
Some features may require a paid subscription, usage-based plan, storage plan, or other commercial arrangement. Pricing, billing intervals, renewal terms, usage limits, trial terms, and refund rules may be described in the applicable order form, pricing page, invoice, or product interface.
If a subscription automatically renews, the user authorizes recurring charges unless the subscription is canceled in accordance with the applicable billing terms.
We may change plans, features, or pricing prospectively where permitted, but we will not be required to continue offering any particular feature indefinitely.
Availability and Changes
We may update, modify, suspend, or discontinue any part of Eyedeea Photos at any time, including features, integrations, storage limits, AI functionality, or supported platforms. We will use reasonable efforts to maintain service availability, but uninterrupted or error-free operation is not guaranteed.
Suspension and Termination
We may suspend or terminate access to the service if a user violates these terms, creates security or legal risk, fails to pay required fees, or uses the service in a way that could harm Eyedeea Photos, its users, or third parties.
Users may stop using the service at any time. Termination does not automatically remove obligations that by their nature should survive, including payment obligations already incurred, ownership provisions, disclaimers, limitations of liability, and dispute-related terms.
Intellectual Property
Except for user content, Eyedeea Photos and its related software, branding, interfaces, documentation, and service materials are owned by Eyedeea Photos or its licensors and are protected by applicable intellectual property laws.
These terms do not grant users ownership of the service or any rights to use trademarks, logos, source code, or proprietary technology except as expressly allowed.
Disclaimers
Eyedeea Photos is provided on an "as is" and "as available" basis to the maximum extent permitted by law. To the extent allowed by law, we disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.
Limitation of Liability
To the maximum extent permitted by law, Eyedeea Photos and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the service.
To the maximum extent permitted by law, the total liability of Eyedeea Photos for any claim arising out of or relating to the service will not exceed the amount paid by the user to Eyedeea Photos for the service during the twelve months before the event giving rise to the claim, or, if no amount was paid, a reasonable minimum amount to be finalized by the company.
Indemnity
Users agree to defend, indemnify, and hold harmless Eyedeea Photos and its affiliates, officers, employees, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising out of or related to the user's content, misuse of the service, or violation of these terms, except to the extent caused by our own gross negligence, willful misconduct, or other non-waivable legal fault.
Governing Law and Disputes
These terms are governed by the laws of the applicable jurisdiction, to be finalized during legal review. Any dispute resolution process, venue, arbitration terms, class action waiver, or court selection language should be added during final legal review.
Changes to These Terms
We may update these terms from time to time. If we make material changes, we may update the effective date and provide notice where appropriate. Continued use of the service after updated terms take effect means the user accepts the revised terms.
